The Environmental Protection Agency (EPA) is the federal authority which regulates waste nationwide. In Florida, the state authority that supervises the EPA's regulation is the Florida Department of Environmental Protection (FDEP). Applicable statues in Florida include Florida Statues (FS) Chapters 381 and Chapter 403, Florida Administrative Codes (FAC) Chapters 17-712 and Chapter 10D-104, Rules of the Department of Environmental Protection (DEP), and Rules of the Department of Health (DOH). DOH regulates the identification, packaging, storage and treatment of biohazardous waste at the generating facility. A fine of $2,500 per day per violation is authorized by law and may be levied against violators during an enforcement action.

The improper handling and/or disposal of medical waste can pose serious health risks to the generator and everyone in the community. Medical waste or "sharps" are objects such as needles, syringes, lancets and other sharp objects used for medical purposes. EPA, OSHA, and Florida state regulations require that medical waste be properly handled, treated, and disposed of by a licensed medical waste disposal company.

Every year, biomedical waste (potentially infectious materials such as needles, blood products, etc.) is disposed of improperly, placing sanitary workers as well as the general public at risk for contracting dangerous diseases. Needles and other medical waste may be contaminated with Hepatitis, HIV, AIDS, and other infectious diseases that can cause severe illness or even death. The Florida Legislature has passed laws to regulate the healthcare industry and any businesses that have needles to discard or produce biomedical waste.
